By accessing or using our platform, you agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree to these Terms, you must not use our services.

2. Definitions

• “Platform” refers to our website, mobile application, and services provided by us.
• “User” refers to any individual or entity that uses the Platform, including private clients, carers, homecare agencies, and care homes.
• “Service Provider” refers to carers, homecare agencies, and care homes offering care services through the Platform.
• “Client” refers to any individual or entity seeking care services or posting job advertisements on the Platform.

3. User Accounts

• Users must register for an account to access certain features of the Platform.
• Users agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• Users are responsible for maintaining the confidentiality of their account password and for all activities that occur under their account.

4. Platform Services

• The Platform provides a venue for Clients to find Service Providers and for Clients and Service Providers to post and respond to job advertisements.
• We do not provide, control, or manage the care services offered by Service Providers nor do we engage in any caregiving or employment relationships.

5. Use of the Platform

• Users agree to use the Platform only for lawful purposes and in accordance with these Terms.
• Prohibited uses include, but are not limited to, using the Platform to facilitate illegal acts, infringe upon others’ rights, or transmit harmful or malicious content.

6. Content and Intellectual Property

• Users retain ownership rights of the content they submit to the Platform but grant Caring Pulse a worldwide, perpetual, irrevocable, royalty-free license to use, modify, distribute, and display the content in connection with the Platform.
• The Platform and its original content, features, and functionality are and will remain the exclusive property of Caring Pulse and its licensors.

7. Fees and Payments

• Caring Pulse may charge fees for certain features of the Platform. Any applicable fees will be communicated to Users and are subject to change.
• Users are responsible for all charges incurred under their account, including applicable taxes, fees, and surcharges.

8. Disclaimers and Limitation of Liability

• The Platform is provided on an “as is” and “as available” basis. Caring Pulse expressly disclaims any warranties of any kind, whether express or implied.
• Caring Pulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use of or inability to use the Platform.

9. Indemnification

• Users agree to defend, indemnify, and hold harmless Caring Pulse and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with their access to or use of the Platform.

10. Termination

• Caring Pulse reserves the right to terminate or suspend access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if Users breach the Terms.

11. Governing Law

• These Terms shall be governed and construed in accordance with the laws of UK, without regard to its conflict of law provisions.

12. Changes to the Terms

• Caring Pulse reserves the right, at its sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Platform after those revisions become effective, Users agree to be bound by the revised terms.
